These Terms & Conditions (“Terms”) govern your use of Equipments Depot’s website, services, and products, and outline the contract between you (“Customer”) and Equipments Depot LLC (“Company,” “we,” “us”). By placing an order, requesting services, or using this website, you agree to be bound by these Terms. If you are entering into an agreement on behalf of a company or organization, you confirm that you are authorized to act on their behalf.

 
1. Scope & Acceptance
  • These Terms apply to all inquiries, quotes, purchases, and deliveries of shipping containers, modifications, and related logistics.
  • Any amended or additional terms must be agreed to in writing by a duly authorized representative of Equipments Depot.
2. Quotations & Orders
  • Quotations are valid for 30 days, unless otherwise stated in writing.
  • An order is confirmed once the Customer submits a signed order form or purchase agreement and payment has been initiated.
  • Prices quoted exclude delivery charges, taxes, duties, and other applicable fees, unless expressly stated.
3. Payment Terms
  • Accepted payment methods: wire transfer and cashier’s check only.
  • Payment in full is required before dispatch. Orders are not released for shipment until funds are confirmed.
  • For wire transfers, all banking fees are the responsibility of the Customer. Please reference your invoice number in the transaction.
  • Partial or delayed payments may result in order processing delays or cancellation.
4. Delivery & Site Conditions
  • Delivery timelines depend on container availability, customization, and geographic location, as detailed in our Shipping & Delivery Policy.
  • It is the Customer’s responsibility to ensure site access is suitable for the delivery vehicle and personnel.
  • If delivery cannot be completed due to site-access issues, additional charges for rescheduling or re-delivery may apply.
5. Inspection & Acceptance
  • Customers must inspect the container at delivery and report any functional concerns within 24 hours.
  • By signing the delivery receipt, the Customer acknowledges acceptance of the container in its delivered condition.
  • Any disputes will be resolved per our Returns & Refund Policy.
6. Title & Risk of Loss
  • Title and risk of loss or damage pass to the Customer once the container is dispatched from our facility.

  • Insurance during transit is optional and should be arranged by the Customer unless otherwise agreed in writing.

7. Warranties & Limitations
  • Equipments Depot warrants that containers will conform to their advertised condition class (One‑Trip, CW, WWT, etc.).
  • Containers are sold “as‑is, where‑is”, except for any additional express warranties provided in writing.
  • To the fullest extent permitted by law, all implied warranties (including merchantability or fitness) are disclaimed.
8. Limitation of Liability
  • Equipments Depot’s liability for any claim arising under these Terms is limited to the purchase price paid for the affected container(s).
  • We are not responsible for indirect, incidental, consequential damages, including loss of profit, earnings, or business interruption.
  • All liability claims must be submitted in writing within 7 days of delivery.
9. Returns & Cancellations
  • All sales are final once payment is confirmed and container is dispatched.
  • Cancellations may be accepted before dispatch, subject to a 10% administrative fee, if no modifications have been made.
  • Custom or modified units cannot be cancelled once production has begun.
10. Intellectual Property
  • All website content—including text, images, logos, and manuals—are owned by Equipments Depot or used with permission.
  • Unauthorized use, reproduction, or distribution is prohibited.
11. Confidentiality

All non-public business information shared by either party, including pricing or project data, will be treated as confidential unless legally required to be disclosed.

12. Compliance & Permits
  • The Customer is responsible for obtaining any necessary permits, licenses, or approvals required for the container’s intended use or delivery location.
  • Containers are sold in compliance with applicable U.S. and international standards, such as ISO and CSC, unless noted otherwise.
13. Governing Law & Dispute Resolution
  • These Terms are governed by the laws of the State of Arizona, excluding its conflict-of-laws principles.
  • Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state or federal courts in Cochise County, Arizona.
14. Miscellaneous
  • If any part of these Terms is held unenforceable, the remaining provisions will remain in full effect.
  • No failure or delay in enforcing any right will constitute a waiver.
  • These Terms represent our entire agreement and supersede all prior discussions or agreements, whether written or oral.
